Update of the contractual provisions (June 2026)

Overview of changes

In the course of updating our contractual provisions, we have made various adjustments. The aim of these changes is to increase transparency, take regulatory requirements into account and map new DeepServices and new functions of existing DeepServices of DeepCloud AG.

Below you will find an overview of the main changes:

1. General Terms and Conditions of DeepCloud AG

• A new section on DeepServices with AI regulates their use, the rights to inputs and outputs and the owner’s responsibility.
• The DeepSign rules have been expanded to include OnPrem use, required audit and access rights, reporting obligations in the event of security incidents and the use of the DeepValidator.
• The ordering and payment process has been revised, including the subscription overview, pro rata temporis billing and card payment
• The availability and support regulations have been clarified, such as rate limiting and the definition of support times.

2. Agreement on commissioned data processing (ADV)

• Clarification of the regulations with regard to data transfers, whereby the principle of “no data transfer to third parties” continues to apply
• Inclusion of regulations on existing confidentiality obligations of customers
• Obligation to inform and right of objection for the customer also in the event of changes to the data processing location
• Updating the list of “Other processors”
